Phantom service is a temporary digital network communication service that enhances Internet security and privacy. According to your personal requirements and your sole discretion, we will automatically provide unregulated and unmonitored data pipelines - Virtual Private Network (VPN) connections - for your exclusive use. You are fully responsible for using Phantom services. Phantom assumes no responsibility for actions taken by users, including criminal and civil liability for damages performed or not performed. Other provisions of these terms further limit Phantom's liability.

We grant you a license to use Phantom services, but subject to the restrictions set forth in these terms. You use Phantom services at your own risk. Phantom services may be modified, updated, interrupted or suspended at any time without notice or liability. We assume no responsibility for any harm or other adverse consequences to you resulting therefrom. Phantom, its owners, employees, agents and other personnel associated with Phantom services are not responsible for any form of damage, performed or not performed, arising from or caused by the use of or registration with any account.

Phantom guarantees normal service operation, but due to network or regulatory restrictions in your region that prevent you from logging in or connecting to some or all servers (for example, mainland China is not supported), Phantom assumes no responsibility for this.

Phantom is not responsible for any monetary or non-monetary losses paid by customers to parties other than Phantom, and this does not include attorney fees or court costs, regardless of any law or other written statute.

Intellectual Property

Under these terms and conditions, we grant you a limited, non-exclusive, personal, non-transferable, non-sublicensable license to:

• Download and use a copy of Phantom software.
• Use Phantom services, including but not limited to products and services provided on or through Phantom software or our website. Under Phantom services, this agreement does not grant you any other rights or licenses. The license provided herein remains in effect until termination. If you do not comply with these terms, the license will automatically terminate.

Phantom services (including but not limited to Phantom software, mobile applications and all other items) are owned and copyrighted by Phantom and are protected worldwide. We reserve all rights, ownership and interests in Phantom services and any part thereof, including but not limited to all copyrights, trademarks, service marks, trade secrets and other intellectual property. You may not take any action that would jeopardize, limit or in any way interfere with our ownership and rights to Phantom services. All rights are reserved unless otherwise stated.

Prohibited Activities

Your access to and use of Phantom services is subject to these terms and all applicable laws and regulations. For any user who violates any applicable law or these terms, we reserve the right to terminate or block their access to Phantom services at any time at our sole discretion, with or without notice.

When using Phantom services, you agree not to assist, encourage or allow others to use Phantom services:

• For improper, prohibited, illegal, criminal or fraudulent activities, including but not limited to port scanning, sending spam, sending opt-in emails, scanning open relays or open proxies, sending unsolicited emails or sending any version or type of email even if routed through third-party servers, any popup launches, using stolen credit cards, credit card fraud, financial fraud, cryptocurrency fraud, impersonation, extortion, blackmail, kidnapping, rape, murder, selling stolen credit cards, selling stolen goods, providing or selling prohibited, military and dual-use goods, providing or selling controlled substances, identity theft, hacking, forgery, phishing, scraping of any form or scale, digital piracy, intellectual property infringement and other similar activities
• Attacking, interfering with, gaining unauthorized access to, or denying service to any other network, computer or node through Phantom services in any way or form.
• Exploiting children in any way, including audio, video, photography, digital content, etc.
• Uploading or distributing files containing viruses, worms, Trojans, corrupted files or any other similar software or programs that may damage the operation of others' computers in any way.
• Interfering with or attempting to interfere with the normal operation of Phantom services, any transactions related to Phantom services or any other activities we conduct, disrupting our website or any network connected to Phantom services or bypassing any measures we may use to prevent or restrict access to Phantom services.
• Using Phantom services in any unauthorized manner, including but not limited to intrusion or increasing network capacity.
• Using any robots, spiders, scrapers or other automated means to access our website or Phantom services for any purpose without our prior written permission.
• Collecting or gathering personal information about other users of Phantom services.
• Collecting or gathering personal data without legitimate interest or consent, or in violation of any applicable law.
• Taking any action that may impose an unreasonable or disproportionately large load on our infrastructure.
• Sharing any data or other content with an unreasonable number of people, including but not limited to sending explosive communications to a large number of recipients or sharing content with people you do not know or who do not know you.
• Representing that you are a representative of any Phantom service (including any of its features).
• Incorporating Phantom services or any part thereof into any other program or product.
• Copying or duplicating any part of Phantom services in any form or by any means.
• Modifying, translating, reverse engineering, decoupling, disassembling or creating any derivative works based on Phantom services, including any files or documentation thereof, or any part thereof, or determining or attempting to determine any source code, algorithms, methods or techniques contained in Phantom applications or any part thereof.
• Violating general moral or ethical standards, good customs and fair conduct standards.
• Infringing the rights of any third party, including any violation of confidentiality, personal data, copyright or any other intellectual property or ownership rights.
• Threatening, stalking, harming or harassing others, or promoting bigotry or discrimination.
• Attempting to manipulate Phantom names, services or products.
• Soliciting or collecting personal information from minors or communicating with minors.
• Attempting to gain unauthorized access to Phantom services, user accounts, computer systems or networks connected to Phantom services through hacking, password mining, brute force or any other means.
• Using Phantom services for any military purposes, including cyber warfare, weapons development, design, manufacture or production of missiles, nuclear, chemical or biological weapons.
• Otherwise violating or circumventing these terms.

In addition, if long-term bandwidth occupation for downloading causes server network abnormalities and affects other users' normal use, Phantom will take measures to limit the network speed of abusive IPs.

For your account security, non-customized accounts are for personal use only. Please do not share your account with others. You will bear the losses caused by sharing with others.

We reserve the right to refuse service, suspend accounts or restrict access to Phantom services at our sole discretion. Phantom may immediately implement such suspension or access restrictions without any instruction, notice or refund. We may suspend your account for clarification, investigation, or require you to explain your actions and provide additional information. If your account has been suspended, you must contact us for more information. We may suspend your user account for a reasonable period of time before we permanently terminate the user account.

We have no obligation to enforce terms against you. We encourage you to let us know of any Phantom user violations of these terms. however, if such violations occur, we may take appropriate action at our sole discretion.

Disclaimer

We will strive to prevent interference with the website and services. However, these contents are provided on an \"as is\" and \"as available\" basis, and we do not guarantee (express or implied) the accuracy of any materials or information provided through this website or service, or their applicability to any specific purpose. We expressly disclaim any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose or non-infringement. We do not guarantee that this service will meet your requirements, nor do we guarantee that it will be uninterrupted, timely, secure or error-free, nor do we correct any defects. Phantom reserves the right to investigate issues we believe violate these terms. We may (but are not obligated to) remove, block, filter or restrict any materials or information that we believe are actual or potential violations of the restrictions set forth in these terms, and any other activities that may make Phantom or our customers liable, at our sole discretion and without notice. Phantom assumes no responsibility for any failure on our part to prevent such materials or information from passing through the \"Service\" and/or entering your computing device.

Applicable Law

Keeping your information confidential is our core mission. To fulfill this mission, Phantom's registered business location is in Albania, Albania has complete data protection regulations, and Phantom complies with the laws of the server location or the requirements of law enforcement agencies.

Please note that Phantom does not collect any IP addresses, browsing history, traffic data, etc.
